Before You Proceed
- Instruction: We can only act if instructed by the detainee directly, or by a third party (family/friend) provided the detainee confirms they wish to instruct us upon our arrival [1].
- Existing Representation: We cannot obtain information from the police if the detainee has already instructed another solicitor or requested the Duty Solicitor. The police will not discuss the case with uninstructed parties [2].
- Juveniles (Under 18): We can accept instructions from an Appropriate Adult (parent/guardian), but the juvenile must agree to the legal representation [3].
- Confidentiality: All communications are strictly confidential and protected by Legal Professional Privilege [4].
What we CAN do: We will speak to you in private. The police are not permitted to listen to our legal consultation or read our notes.
What we CANNOT do: We cannot share information with your family, friends, or employer without your express permission. We cannot even confirm to a caller that you are in custody unless you specifically authorise us to do so.
Limited Information: Please be aware that we typically receive very limited information about the allegation until we arrive at the police station. Even then, we can only disclose full details to family or friends if the client explicitly authorises us to do so.
- No Speculative Enquiries: We cannot make speculative calls to police stations to "check" on people without a valid instruction [5].
